The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 325, 307, 337, 338, 353, 427, 504, 506 of the Indian Penal Code and Section 30(b)(c) of the Bihar Prohibition & Excise Act. It is alleged that on receiving information that one Shambhu Rai is selling illicit liquor at his door, the informant being Sub-Inspector went along with other police personnel. On seeing the police parties, the accused persons started fleeing from the spot, however

It is alleged against this petitioner that she along with her husband Shambhu Rai and other family members forcibly set Pukar Mahto free from the clutches of the police and made assault to the police personnel, as a result of which, one police constable sustained grievous injuries.

It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this case. The petitioner was not apprehended from the spot, nor anything has been recovered from the conscious possession of the petitioner. It is further submitted that since petitioner is a candidate of Mukhiya in the upcoming election, hence, she and her other family members have falsely been implicated in this case. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.
