JUSTICE ARUN KUMAR ORAL ORDER 19-01-2018 Heard learned Counsel for the petitioner and the State as also the learned Counsel appearing on bwehalf of the informant. Petitioner, already in custody, seeks bail in Marhowrah PS Case No. 367 of 2017 registered under Sections 341, 342, 323, 365, 427, 504 and 506/34 of the IPC.

Submission is that in fact the informant's relative Arvind Rai, who is alleged to have been kidnapped by the petitioner along with others, had come to the petitioner's house with fire arm and he was caught by the petitioners side and produced before the police with the arms for which Marhowrah PS Case No. 366 of 2017 was instituted and subsequently this case was lodged. Moreover the petitioner's father has political rivalry with the present informant who is Ex-MLA, the police has submitted charge-sheet and the petitioner is in custody since 11.11.2017. It is also submitted that the informant on the previous dates had lodged false cases against the petitioner and except that there is no criminal antecedent against the petitioner.

Having considered the said facts and circumstances, the petitioner, namely, Akhilesh Rai @ Akhilesh Prasad Yadav is

No.63501 of 2017 (3) dt.19-01-2018 directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Rajesh Singh, Judicial Magistrate, Saran at Chapra in connection with Marhowrah PS Case No. 367 of 2017.
