The petitioner apprehends his arrest in connection with Siwan Town P.S. Case No. 359 of 2022 registered under Section 306 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that on perusal of paragraph-41 of the case diary, it would be evident that from 01.05.2022 to 06.06.2022(date of occurrence), total 233 times the petitioner and the deceased had talked to each other, in which the deceased had called 172 times and the petitioner had called only 61 times. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Siwan Town P.S. Case No. 359 of 2022, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
