2. The petitioner apprehends his arrest for the offences alleged under Sections 420, 467, 468, 471, 472 and 473 registered in connection with Bihar P.S. Case No. 19 of 2018.
3. It is submitted that the petitioner has been falsely implicated in connection with sale of land of the informant's mother by the petitioner through a fake lady named as Shanti Devi as he is said to have merely identified the seller and has not received any consideration amount from the informant. The purchaser of the land, namely, Sulekha Devi @ Sulekha Sinha has already been granted anticipatory bail by this Court vide order dated 05.04.2018 in Cr. Misc. No. 19266 of 2018.
4. It appears from the allegation that sale of land was conducted by the petitioner through a fake lady, Shanti Devi in place of the informant's mother and the petitioner has identified the seller. The purchaser of land Sulekha Devi stands on different footing as she herself can be said to be a victim of the
Patna High Court Cr.Misc. No.73790 of 2018(3) dt.21-01-2019 2/2 broker rather perpetrator.
5. Having regard to the nature of accusations and gravity of offence alleged, this Court is not inclined to grant anticipatory bail to the petitioner. Bail petition stands dismissed.
6. If the petitioner surrenders and seeks regular bail before the learned trial Court, the same shall be considered on its own merit in accordance with law and without being prejudiced by any observation in the present order. (Vikash Jain, J) BT/Chandran U T
