Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 325, 307, 354B, 379, 427, 504, 506 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that on 16-8-2023, petitioner along with other named accused started throwing wood kept on the land of informant and on protest, the petitioner assaulted the informant by an iron rod causing injury on head, thereafter Vijendra assaulted the informant by lathi on her hand and Nitish snatched her golden mangalsutra, thereafter Bipul slammed her daughter on floor by

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is also submitted that petitioner and informant are agnates and on account of dispute relating to property, the instant false case came to be instituted. It is next submitted that no doubt it is alleged that petitioner assaulted the informant causing injury on head by an iron rod but then from perusal of order impugned, it would manifest that the same records that the injury suffered is simple in nature. It is also submitted that blow was not repeated which amply demonstrates that petitioner never had any intention to commit a serious occurrence and petitioner is not a criminal.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount
