JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,324,307,504 and 506/34 of the Indian Penal Code.

The accusation against the petitioner is that on protest being made by the informant for abusing, he caused injury on the head of the father of the informant by throwing bricks.. It is submitted by the learned counsel for the petitioner that petitioner and informant are agnates of each other and for a petty dispute the occurrence took place. It is further submitted that there is counter version of the occurrence wherein the injury of the father of the informant has been found to be simple. Considering the genesis of the occurrence and statement made in paragraph 3 of the petition that the petitioner

No.2862 of 2016 (2) dt.19-01-2016 2/2 has no criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Nalanda at Biharsharif in connection with Bihar (Nalanda) P.S. Case No.473 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
