The petitioner seeks bail in a case instituted for the offences under Sections 147, 143, 186, 224, 225, 307, 353/34 of the I.P.C. and Sections 37(b) and 45 of the Bihar Prohibition and Excise Act, 2016.
Prosecution case, in short, is that the informant got secret information that one Suresh Sahni was creating clamouring in drunken state in village Bakhari, then he along with other police personnel reached there and on seeing them one person started to flee, but he was apprehended, who disclosed his name as Suresh Sahni and then the accused persons including the petitioner and 10-15 unknown persons surrounded police vehicle and attached on police team.
Patna High Court Cr.Misc. No.63518 of 2017(3) dt.16-02-2018 2/2 It has been submitted on behalf of the petitioner that the petitioner is in custody since 06.11.2017. Charge sheet/prosecution report has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is said to be a member of unlawful assembly, who was protesting on the arrest of co-accused Suresh Sahni. The petitioner was not apprehended on the spot. The name of the petitioner has come in the present case as being one of the protestor on the arrest of co-accused. Except for this, there is no other substantive evidence to suggest the implication of the petitioner in the present case.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R./complaint case.
Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Motihari, East Champaran in connection with Mehsi P.S. case No.48 of 2017.
