The petitioner is apprehending arrest in a case registered for the offences punishable under sections 147,148,149,341,323,504,506,224,225,307,333,337,338 and 427 of the Indian Penal Code and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act. The prosecution case is that the informant being ASI of Police went to village Noao Tola to investigate Kachhawan P.S. Case No. 42 of 2015 and arrested one Pramod Yadav when the accused persons including the petitioner abused the informant and got released the apprehended accused, made assault to the police and damaged the police vehicle.
Patna High Court Cr.Misc. No.1618 of 2016 (2) dt.13-01-2016 2/2 It is submitted by the learned counsel for the petitioner that the accusation is omnibus and general against the mob. The thrust of accusation is against Pramod Yadav. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the nature of accusation levelled against the mob, it is a case for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Kachhawan P.S. Case No. 43 of 2015 pending in the court of learned JM, Bikramganj, Rohtas.
This application is disposed of with the aforesaid observation/direction.
