Petitioner is apprehending his arrest in Raja Pakar P.S. Case No. 153 of 2015 for offence under Sections 25(1-B)a, 26 and 27 of the Arms Act.
The prosecution case is that the informant, being the police officer, on 06.11.2015 during patrolling received information with regard to firing and when the raid was led three persons were found standing behind the liquor shop, but, they managed to escape from the alleged place. One loaded pistol was recovered along with one cartridge from the place of scene. Subsequently, the liquor shop owner disclosed the name of the petitioner as a person escaped from the scene. It is submitted by the learned counsel for the petitioner that the petitioner was made accused in two other cases, one under Section 414 of the Indian Penal Code and other under Section 392 of the Indian Penal Code. In the case registered under Section 414 of the Indian Penal Code final form has been submitted and the petitioner is on bail in other case. The statement
Patna High Court Cr.Misc. No.46027 of 2016 (2) dt.22-10-2016 in that regard has been made in paragraph 3 of the petition. Considering the facts and circumstances, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Raja Pakar P.S. Case No. 153 of 2015 to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
