Petitioner seeks bail in a case registered for the offences punishable under Sections 147,148,149,323,324,307 of the Indian Penal Code and Section 27 of Arms Act. According to FIR, others had also fired. There is specific averment that firing of this petitioner had caused injury at the thigh of Akhilesh Ram. The Doctor who initially examined Akhilesh Ram on 11.09.2018 found oval shaped inverted margin and profused bleeding on the back of the right thigh, however, opinion regarding nature of injury was kept reserved and subsequent opinion dated 26.02.2019 would reveal that the Doctor found injury at the back of the neck. The report appears to have been submitted by the same Doctor. Petitioner is in custody since 31.07.2018.

Considering the facts and circumstances of this

Patna High Court CR. MISC. No.70048 of 2018(5) dt.11-04-2019 2/2 case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Korma Police Station Case No.52 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

Let the Principal Secretary, Health Department, Govt. of Bihar get it enquired regarding reason for such conflicting report by the same Doctor and submit a report to this Court within eight weeks for reference in this matter. Let a copy of this order be sent to the Principal Secretary, Health Department, Govt. of Bihar alongwith photo copy of both the reports be sent to the Principal Secretary, Health Department, Govt. of Bihar.
