JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 11-07-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application, for grant of anticipatory bail, arises out of Thakurganj (Sukhani) P. S. Case No. 43 of 2014, disclosing offences under Sections 302 and 120(B)/34 of the Indian Penal Code.

Since this application arises out of case alleging offence punishable under Section 302 of the Indian Panel Code, I am not inclined to grant the privilege of anticipatory bail to the petitioner. More so, because in course of investigation, the police have collected certain material showing the involvement of the petitioner.

Accordingly, this application stands rejected.

No.58184 of 2015 (3) dt.11-07-2016 2/2 The petitioner, above-named, is directed to surrender before the court below within a period of four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned court below on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
