JUSTICE SUDHIR SINGH ORAL ORDER 08-09-2017 In the present writ application, the following reliefs have been sought for on behalf of the petitioners. (i) For issuance of writ/writs in the nature of mandamus commanding the respondents particularly respondent State Government to grant revised pay scale of Rs.13,000-420-18,300, which is the replacement scale of Rs.3700-5700 w.e.f. 1.1.1996 as per revised U.G.C. pay scale and they are also entitled for next higher pay scale of Rs.16400-450-20900-500-22400/- since after their first time bound promotion neither promotion nor promotional benefit have been provided to them.
Patna High Court CWJC No.10432 of 2012(4) dt.08-09-2017 2/3 (ii) For issuance of writ/writs, order/orders and direction in the nature of mandamus commanding the respondents to revised petitioners pay scale under Sixth Pay revision scheme after grant of pay scale of Rs.12000-420-18300 which is the replacement scale of Rs.3700-5700 w.e.f. 1.1.1996. (iii) For issuance of suitable writ/writs, order/orders and direction to the respondents for all other consequential benefit including arrears of salary to these petitioners pursuant to replacement of pay scale firstly in scale of Rs.12000-420-18300 (replacement pay scale of 3700-5700 w.e.f. 1.1.1996) and thereafter replacement in next higher pay scale in the light of sixth pay revision in pay scale of Rs.37400/- to 67000/- w.e.f. 01.01.2006. (iv) For issuance of necessary writ/writs, order, direction and declaration to the respondents that petitioners are also entitled for suitable interest including statutory interest as well as penal interest to the amount which is due to them from the date of entitlement till the date of final payment.
(v) For issuance of necessary writ(s) order and direction to respondents that petitioner is entitled for next higher pay scale i.e. 37400-67000/- as per sixth pay revision w.e.f. 01.01.2006, including arrears of salary a well consequential benefits." The wife of the petitioner No.1, namely, Dr. Smt. Purnima Prasad died during the pendency of the present writ application
Patna High Court CWJC No.10432 of 2012(4) dt.08-09-2017 3/3 and in the said circumstances the petitioners' name was substituted on place of Dr. Smt. Purnima Prasad by order dated 26.11.2014.
Considering the reliefs sought for in the present writ application, the petitioners are directed to file a representation before the Respondent No.2, The Director, Higher Education, Human Resources Department, New Secretariat, Patna, Bihar. The Respondent No.2 shall dispose of the representation of the petitioners, taking into consideration the Annexures-2 and 7 to the writ application, in accordance with law within a period of three months, from the daqte of receipt of such representation. With the aforesaid observation and direction, the present writ application stands disposed of.
