Petitioner apprehends arrest in a case registered for the offence punishable under Sections 379, 384, 504, 506/34 of the IPC.

As per the prosecution case, the petitioner along with other 10-12 unknown persons armed with deadly weapons reached at wheat field of the informant and demanded Rs. 1Lac as extortion money and thereafter on 13.04.2022 the petitioner along with 10-12 persons looted all the crops of the informant. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. The petitioners are co-villagers and land dispute is going on between the parties. There is delay of 5 days in lodging

Patna High Court CR. MISC. No.44134 of 2022(2) dt.05-12-2022 2/2 the FIR. Petitioner has got no criminal antecedent. Learned counsel appearing for the State opposes the prayer for bail.

Considering the delay in lodging the FIR, in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Gopalganj in connection with Kateya P.S. Case No. 158 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
