2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 341, 323, 325, 354(A), 379, 504, 506/34 of the Indian Penal Code.
3. Petitioner is alleged to have assaulted the informant and his family members. It is further alleged to have snatched golden chain of the informant.
4. It is submitted that informant is own wife of this petitioner and due to family dispute this false and concocted case has been lodged. Prior to this case informant has also lodged another case on 12.06.2021 Brahmpur P .S. Case No. 294 of 2022 against petitioner , which was a matrimonial case between the parties. Rest of the allegation is super-addition to
Patna High Court CR. MISC. No.44621 of 2023(2) dt.08-08-2023 2/2 make the present case grave .
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the matrimonial dispute between the parties and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxxar in connection with Brahmpur P.S. case no 197 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
