====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 25-07-2023 Heard learned counsel for the petitioner and the learned APP for the State.

2. Petitioner seeks regular bail in connection with Desari P.S. Case No. 158 of 2022 dated 13.04.2022 registered for the offences punishable under Sections 363 and 366/34 of the Indian Penal Code.

3. The main submissions advanced by learned counsel for the petitioner are that the allegations made in the FIR are totally false and the same have been falsified by the victim in her statement recorded under Section 164 of Cr.P.C. before the Judicial Magistrate and she stated before the Judicial Magistrate that she left her parents' house with this petitioner on account of being beaten by her mother and finally she solemnized marriage with this petitioner. Patna High Court CR. MISC. No.44499 of 2023(2) dt.25-07-2023 2/2 are that while recording her statement, the victim disclosed her age as 20 years before the Judicial Magistrate and in the present time she is residing at petitioner's house as his wife and the petitioner is a very young person having fair and clean antecedent and has been languishing in jail since 22.05.2023 and against him the investigation has been completed.

4. Learned APP appearing for the State has opposed the bail prayer.

5. Having regard to the facts and circumstances of this case, in my opinion it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned in connection with Desari P.S. Case No. 158 of 2022. (Shailendra Singh, J) annu/- U T
