JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 19-01-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This application for grant of anticipatory bail arises out of Piar P.S. Case no. 88 of 2015, disclosing offences under sections 406, 409, 420, 465, 466, 467, 468, 469 of the Indian Penal Code.

It is alleged that using the voter identity card of the informant, petitioner got issued Sim card in his name and he used the mobile phone for extracting money from several persons. From the present application seeking anticipatory bail I find that the petitioner is accused in several cases with the allegation of committing forgery.

In the facts and circumstances of the case, I am

Patna High Court Cr.Misc. No.2529 of 2016 (2) dt.19-01-2016 not inclined to grant privilege of anticipatory bail to the petitioner in connection with Piar P.S. Case no. 88 of 2015 pending in the court of the learned Additional Chief Judicial Magistrate-cumSubordinate Judge Vth, Muzaffarpur. Petitioner is directed to surrender before the court below within three weeks from today and seek regular bail, if so advised. If he does so, the court below shall consider his application for regular bail on its own merit without being prejudiced by rejection of the present anticipatory bail application by this Court.
