The prayer of the petitioner was earlier permitted to be withdrawn vide order dated 08.12.2017 for him to approach this Court again after a reasonable period time. The aforesaid order was passed in Cr. Misc. No. 45684 of 2017.

The petitioner is the husband of the deceased and is being tried in a case instituted for the offence under Section 304(B) of the I.P.C.

A report had been called for from the trial court to ascertain the stage of this case. The report, which has been

Patna High Court Cr.Misc. No.71919 of 2018(3) dt.20-02-2019 2/2 received, has been kept at flag 'X'. The report indicates that out of four prosecution witnesses, three have already been examined.

Learned counsel for the petitioner has submitted that there are some other developments after the report was sent, which is that even the fourth prosecution witness has now been examined and the case is pending judgement. Under the aforesaid circumstances, this Court directs the trial court to positively conclude the case and deliver the judgement as early as possible, preferably within a period of three months from today.

With the aforesaid direction, the petition is disposed off.
