The petitioner has preferred this application for grant of regular bail in a case registered under sections 20 and 22 of the Narcotic Drugs and Psychotropic Substance Act, 1985. As per the prosecution case, 12 kgs of ganja besides illicit liquor was recovered from the joint family house of the petitioner.

It is submitted by learned Senior counsel appearing for the petitioner that so far as the alleged recovery of liquor is concerned, a separate F.I.R. has been registered. The alleged recovery of ganja is less than the commercial quantity. The petitioner is in custody since 3.3.2021 and has no criminal antecedent under the NDPS Act.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner not having any criminal antecedent under the NDPS Act and having remained in custody for over 1 year, the Court directs the petitioner to be enlarged on bail in connection with Barh P.S. Case no. 31 of 2021 (Special Case no. 6 of 2021) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, NDPS Act, Patna.
