The petitioners apprehend their arrest in Sanjhauli P.S. Case No.77/2015 registered for the offences punishable under Sections 341, 323, 325, 307, 384, 506/34 of the Indian Penal Code.
It is contended that accusation is general and omnibus in nature against the petitioners and some of the accused persons have been granted bail vide Annexure 4 by a co-ordinate Bench of this Court.
Learned counsel for the State submits that there is direct allegation against the petitioners of assaulting the informant causing fracture in his legs and the injury has been found grievous
Patna High Court Cr.Misc. No.58451 of 2015 (2) dt.29-01-2016 2/2 in nature. The aforesaid fact has been noticed in Annexure-4 while granting bail to the other co-accused persons. Considering the facts and circumstances of the case, in my opinion, the petitioners do not deserve anticipatory bail. Their prayer is rejected.
