JUSTICE BIRENDRA KUMAR ORAL ORDER 04-01-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 304(B) & 34 of the Indian Penal Code.

The petitioner is husband of the victim of dowry death. The case diary would reveal that no witness has supported before the police regarding illegal demand and torture, to be the cause of death. This fact was considered by this Court while considering the prayer for anticipatory bail of this petitioner in Cr.Misc.No.22940 of 2016. The witnesses have stated that the victim died of illness. The postmortem report also does not reveal any external or internal injury.

Patna High Court Cr.Misc. No.55801 of 2017 (3) dt.04-01-2018 Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Kauwakol Police Station Case No.37 of 2015 , G.R.No.1081 of 2015, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
