The petitioner seeks bail in Kahalgaon P.S. Case No. 573 of 2018, instituted for the offence under Section(s) 307, 413, 414 of Indian Penal Code, Sections 25(1-b)a, 26, 27 and 35 of Arms Act.

Counsel for the petitioner submits that petitioner is in custody since 10.9.2018.

It is alleged in the written report that informant during patrolling duty got information that at Samsan Ghat firing has taken place. The informant along with other Police personnel reached there and learnt that one person had been taken away by some other persons with Sumo Victa. The Police found several persons running away. This petitioner was caught

Patna High Court CR. MISC. No.41036 of 2019(2) dt.09-07-2019 2/2 hold by the villagers. On search, one Desi Katta along with live cartridge and one mis-fire cartridge were recovered from possession of the petitioner.

Petitioner is in custody since 10.9.2018.

Keeping in view the period spent by the petitioner in custody, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Kahalgaon P.S.
