====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 15-12-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 427, 307 and 34 of the Indian Penal Code.

The informant alleges that on 01.04.2022 at about 6:30 A.M., when he was sitting at his door, when 20-50 accused persons came on a tractor and Bolero vehicle and started loading bricks after breaking the wall of his house, on protest, it is alleged that petitioner assaulted informant with khanti causing injury on his head and he became unconscious and thereafter other named accused persons assaulted the other family members of the petitioner.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and has been falsely

No.44380 of 2022(2) dt.15-12-2022 2/2 implicated in the present case, it is next submitted that there is a land dispute between the parties and from perusal of the injury report it would manifest that the injury suffered by the injured is simple in nature and a Title Suit No. 13 of 2022 is also pending between the parties in the Court of learned Munsif, Bagha, West Champaran.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Laukariya P.S. Case No. 31 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) GauravSinha/- U T
