Petitioner, already in custody, seeks bail in connection with Tribeniganj P.S. Case No.231 of 2017, registered under Sections 302, 201, 34 of the Indian Penal Code as well as under Section 27 of the Arms Act.
Learned counsel for the petitioner submits that FIR is against unknown, there is no eye-witness in this case and only material against this petitioner is that he called the deceased earlier on his mobile and asked him to come with Scorpio vehicle and both were acquainted and not on inimical terms. Another person, namely, Hari Choudhary was also made
Patna High Court Cr.Misc. No.55924 of 2017(3) dt.25-01-2018 2/2 accused against whom allegation is that he had threatened the deceased a few days ago however, he has been admitted to bail by a coordinate Bench of this Court by order 17.01.2018, passed in Cr. Misc. No.1514 of 2018 and the petitioner has got no criminal antecedent.
Learned counsel for the informant submits that the petitioner is a conspirator in this crime.
Having considered the said facts and circumstances, petitioner Chandan Singh @ Chandan Kumar Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Supaul in connection with Tribeniganj P.S. Case No.231 of 2017.
