====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 16-01-2019 Heard learned counsel for the petitioner, counsel for the informant and the State.

The petitioner seeks bail in Piro P.S. Case No. 319 of 2017, instituted for the offence under Sections 304(B), 201/34 of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act. Petitioner is husband of the deceased.

It is alleged in the written report that daughter of informant was married with petitioner in the year 2009. She was tortured in her sasural for demand of dowry. It is alleged that petitioner took the daughter of informant after Bidaigiri on promise that he will keep her in his house situated near Milki More. It is further alleged that petitioner used to assault and torture his daughter for demand of chain and Motorcycle. On 17.1.2017 at 7:00 p.m. the daughter of informant telephoned and called him because

It is alleged that on 18.11.2017 the informant tried to talk with his daughter on telephone but he did not succeed. He went to house of petitioner situated at Milki More and found the room locked. All the articles were scattered. He also found sign of blood on the bed and gate. Case diary has been received.

Learned A.P.P. has submitted that statement of daughter of deceased namely, Kishu Kumari, aged about six years, has been recorded by the police wherein she has stated that this petitioner after assaulting her mother (informant) had taken her in a car along with his two friends. Thereafter, she (daughter of deceased) was brought to her grandfather's house.

It is mentioned in paragraph-29 of the case diary that dead body was recovered from the Bush.

This Court is therefore not inclined to grant bail to the petitioner at this stage.

Prayer for bail of the petitioner stands rejected. The trial court is directed to expedite the trial. (Sanjay Priya, J) S.Ali/- U T
