The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

1.08 liters of foreign liquor has been recovered from a Pandal and petitioner has been named by co-accused Kundan Kumar, who was apprehended on spot.

It is submitted that nothing has been recovered from the conscious possession of the petitioner and he has been made accused only on the basis on confession of co-accused. However, learned A.P.P. for the State vehemently opposed the prayer for anticipatory bail and submitted that petitioner has got five criminal antecedent, out of which, four are of similar nature.
