JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-02-2017 Heard learned counsel for the petitioners.
The petitioners are apprehending their arrest in connection with Kundawa Chainpur P.S.Case No. 40 of 2016 registered for the offences punishable under Sections 304B and 201 of the Indian Penal Code.
It has been submitted on behalf of the petitioners that petitioner No.1 is elder brother of husband of the deceased and petitioner No.2 is wife of petitioner No.1 and there is general and omnibus allegation against them and earlier to that mother-in-law of the deceased has been granted anticipatory bail by this Court in Cr.Misc.No. 52419 of 2016 by order dated 17.1.2017. Heard learned APP also.
Having heard both sides and considering the fact that co-accused having similar allegation have been granted
Patna High Court Cr.Misc. No.3206 of 2017 (2) dt.09-02-2017 2/2 anticipatory bail and there are general and omnibus allegation against all the accused persons, let the petitioners, named above, in the event of their arrest or surrender in the court below within four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Sikarhana at Dhaka, Motihari, in connection with Kundawa Chainpur P.S.Case No.
40 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further bailors should be local persons having sufficient immoveable properties within the jurisdiction of the court concerned and they will co-operate in the investigation and appear before police, as and when required, and on failure on their part to appear before the police on two consecutive dates without showing any valid ground, their bail bonds shall be liable to be cancelled.
