JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-07-2019 This application, for grant of anticipatory bail, arises out of Excise Case No. 131 C2/ 2018, disclosing offences under Sections 30(a) and 30 (d) of the Bihar Prohibition and Excise Act.

Allegation is of recovery of 20 litres of liquor and 900 kg of java mahua from the maize field.

Submission of learned counsel for the petitioners is that they have no criminal antecedent and have falsely been made accused in this case and the field from which the recovery has been made, does not belong to the petitioners. Heard learned A.P.P. also.

Having heard both sides, in view of the above facts,

Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge - I, Sheikhpura, in connection with Excise Case No. 131 C2/ 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
