The petitioners are apprehending their arrest in connection with Nardiganj P.S.Case No.91/2019 , registered for offences punishable under Sections 149, 341, 323, 307, 385, 379, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.

Prosecution story disclose the allegation of firing against the petitioner no.1 and there are allegations against the petitioner nos.2 to 4 of assaulting the informant by fists and slaps.

Submission of the learned counsel for the petitioners is

Patna High Court CR. MISC. No.42366 of 2019(2) dt.09-07-2019 2/2 that the petitioner and the informant are agnates and though there is allegation of firing but that does not hit anybody, which appears from the FIR itself and no specific allegation is against the petitioner nos. 2 to 4 and now a compromise has been reached between the parties.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M. Ist class, Nawada in connection with Nardiganj P.S.Cas No.91 of 2019, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid direction, this application is allowed.
