JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Manihari P.S. Case No. 78 of 2019 registered for the offences punishable under Sections 498A, 323, 379 of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act.
Petitioner happens to be husband of opposite party No.2 and allegation is that petitioner and others demanded motorcycle and Rs.1 lac from the complainant/informant and for that she was tortured by them and a Panchayati was held but the matter could not be pacified and she was ousted from the house. Submission of learned counsel for the petitioner is that after filing of divorce case by the petitioner the present case
Patna High Court CR. MISC. No.41934 of 2019(4) dt.27-09-2019 2/2 has been lodged and he is not ready to keep her. On the other hand, learned counsel for opposite party No.2 has submitted that she is ready to reside with the petitioner but petitioner does not want to keep her and moreover no expense has been given to her.

In view of above facts and circumstances, let petitioner appear and on condition that he has to pay Rs.3000/- per month to opposite party No.2 for her expenses till any order is passed by the Family Court either in divorce case or in maintenance case to be filed by opposite party No.2, the provisional bail granted to him by order dated 9.7.2019 shall be confirmed. It is made clear that if petitioner fails to pay the above amount continuously for three months, his bail bonds shall be cancelled.
This application is, accordingly, allowed.
