JUSTICE SANJAY PRIYA ORAL ORDER 21-02-2019 Heard the learned counsel for the petitioners, informant and the learned A.P.P. for the State. The petitioners seek bail in Kusheshwar Asthan P.S. Case No. 148/2018, instituted for offences under Section(s) 147, 148, 341, 323, 342, 307, 302, 504 and 506 of the Indian Penal Code.

Learned counsel for the petitioners has submitted that co-accused with similar allegation has already been granted bail by this Court in Cr. Misc. No. 59853/2018 dated 20.11.2018. It is alleged in the written report that on the order of Neeraj Kumar Chaudhary, Ram Lochan Chaudhary, Pankaj Kumar Chaudhary @ Abhishek Kumar (petitioner no. 1) and

Patna High Court Cr.Misc. No.74225 of 2018(4) dt.21-02-2019 2/2 Pushpaj Chaudhary (petitioner no. 2) assaulted Balo Yadav. When Balo Yadav wanted to run away to save himself, all the accused persons caught hold him and assaulted him. The accused persons took Balo Yadav inside the house. Later on dead body of Balo Yadav was found.

Learned counsel for the petitioners has submitted that there is no any specific allegation against these petitioners. Learned counsel for the informant has opposed the prayer of bail of petitioner.

Petitioners are in custody since 08.06.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Biraul, Darbhanga in connection with Kusheshwar Asthan P.S. Case No. 148/2018, subject to the conditions that both the bailors shall be the close relative of the petitioners.
