The petitioner seeks bail in Dagarua P.S. Case No.64 of 2016, corresponding to Sessions Trial No.449 of 2016, registered under Section 307 and other Sections of the Indian Penal Code.
Prayer for bail of the petitioner has already been rejected vide order dated 05.07.2017 passed in Cr. Misc. No.24899 of 2017 with the observation that the petitioner may renew his prayer of bail after remained one year and three months in custody. The petitioner is in jail since 30.08.2016. Petitioner has already remained in jail one year and four months. The learned counsel for the informant as well as Additional P.P. vehemently opposed the prayer for bail and
Patna High Court Cr.Misc. No.61593 of 2017 (2) dt.10-01-2018 submitted that trial is in progress. Petitioner is threatening the informant of dire consequences.
Considering the facts aforesaid and the fact that petitioner is in jail for more than one year and four months and his prayer for bail was earlier rejected with observation that the petitioner may renew his prayer for bail after remaining one year three months in custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Assistant Sessions Judge, Purnea or appropriate court below in connection with Sessions Case No.449 of 2016 arising out of Dagarua P.S.
