Petitioner seeks regular bail in connection with Revelganj PS Case No. 239 of 2021 registered under Sections 392 of the I.P.C.

The informant while coming on motorcycle at about 10 P.M. in the night was intercepted by 04 motorcycle borne miscreants who looted the informant's motorcycle, mobile, cash on the gun point.

Learned counsel for the petitioner submits that petitioner has got no criminal antecedent and he has falsely been implicated by the police with oblique motive. He next submits that petitioner has been made accused on the basis of his self inculpatory confessional statement and the looted motorcycle has not been recovered from the conscious possession of the petitioner but the same has been recovered from the possession

Patna High Court CR. MISC. No.53377 of 2021(2) dt.12-05-2022 2/2 of the co-accused Deepak Natt @ Kullar Natt. The motorcycle which has allegedly been recovered from the petitioner by the police belongs to the brother of the petitioner and in support of his submission learned counsel relies upon Annexure 2 to the bail petition which is certificate of registration of the said motorcycle. Petitioner is in custody since 02/07/2021 and charge sheet has already been submitted.

Regard being had to the submissions made by the parties and taking into consideration the materials available on record, the fact that petitioner has got no criminal antecedent, looted motorcycle has not been recovered from the possession of the petitioner , he is in custody since 02/07/2021 and charge sheet has already been submitted, as such, I am inclined to grant regular bail to the petitioner.

Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate Ist Class, Saran at Chapra in connection with Revelganj PS Case No. 239 of 2019. praful/- (Anil Kumar Sinha, J) U T
