JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-01-2018 The present petition has been brought by the father of the juvenile, viz. Ankit Raj, against the order dated 29.11.2017 passed by the learned District & Sessions Judge, Begusarai in Cr. Appeal No. 104/2017, whereby the order passed by the Principal Member, Juvenile Justice Board, Begusarai dated 03.11.2017 refusing to release the juvenile, viz. Ankit Raj, has been affirmed and upheld.

From the records, it appears that Ankit Raj is aged about 13 years and 5 months and has been declared a juvenile by an order of Juvenile Justice Board. From his school bag, a country made pistol was recovered.

It has been submitted on behalf of the juvenile that the aforesaid pistol was given to him by another juvenile, viz.

Patna High Court CR. REV. No.1251 of 2017 (4) dt.17-01-2018 2/2 Prashant Raj, who has been granted bail.

The appellant is in remand home since 08.09.2017. There is nothing on record, it has been argued, to suggest that the release of the concerned juvenile shall bring him into the company of criminals, thereby jeopardizing his future career. The parents of the juvenile are ready to take care of him and are also desirous of keeping a close watch on the juvenile so that such activities may not be continued by him. Regard being had to the aforesaid facts, the prayer in the present petition is allowed.

The juvenile, viz. Ankit Raj, is directed to be released from the remand home, subject to furnishing of bonds on his behalf by his parents in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount to the satisfaction of the learned Principal Magistrate, Juvenile Justice Board, Begusarai.
