JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-12-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Patrakar Nagar P.S. Case No. 212 of 2016 registered under Section 366A of the Indian Penal Code.
The accusation is of abducting of married daughter of the informant by this petitioner with further allegation that the daughter of the informant was earlier recovered from the house of this petitioner.
Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case mere on suspicion. Moreover, the statement of victim, daughter of the
Patna High Court Cr.Misc. No.47136 of 2016 (2) dt.15-12-2016 informant, was recorded, under Section 164 of the Cr.P.C., on 20.08.2016, in which, she stated that she moved according to her sweet will to Calcutta and from there to Delhi and stayed the residence of her friend Riya due to pressure and harassment by her father, husband and in-laws.
Considering the aforesaid submissions, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the J.M. Ist Class, Patna, in connection with Patrakar Nagar P.S. Case No. 212 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
