JUSTICE MADHURESH PRASAD ORAL ORDER 12-01-2018 Heard learned counsel for the petitioner and the State. Petitioner is an accused in a case registered for offence under sections 396 and 397 of the IPC.

Counsel for the petitioner submits that since the petitioner has been implicated in many other cases mentioned in paragraph 3 of the bail application, his name has been dragged in the instant case also on the confessional statement of co-accused, though he has not been apprehended at the spot nor any recovery has been made from his possession. Petitioner is in custody since 3.2.2017.

Considering the aforesaid submissions, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge I, Madhubani in Sessions Trial No. 293 of 2017, Khajauli Police Station Case No. 131 of 2014 on the following conditions:- (a) One of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner.
