The petitioner apprehends his arrest in Kuchaikote P.S. Case No. 17/2015, registered for the offences punishable under Sections 406, 420, 384 and other Sections of the Indian Penal Code.
The informant Satya Narayan Prasad lodged a Complaint Case No. 1955/2014 alleging therein that the petitioner and others were running a Cheat Fund Company. The informant and many others were made members of the Cheat Fund Company and deposited money in Lucky Super Fixed Scheme but after maturation of the amount the petitioner and others did not return the amount to the subscribers of the cheat fund company. Learned counsel for the petitioner submits that one Ravindra Dubey lodged Kuchaikote P.S. Case No. 125/2013 in
Patna High Court Cr.Misc. No.42458 of 2016 (3) dt.22-11-2016 2/2 which the petitioner had already been granted anticipatory bail vide order dated 20.01.2014 passed in Cr. Misc. No. 2890/2014 on the assertion that the occurrence took place in the year 2004-2005 but the complaint was filed in the year 2013. It is submitted that the informant and other witnesses of Kuchaikote P.S. Case No. 125/2013 lodged the present case along with Kuchaikote P.S. Case No. 18/2015 and Kuchaikote P.S. Case No. 19/2015. The petitioner has already been granted anticipatory bail vide order dated 19.10.2016 passed in Cr. Misc. No. 43770/2016 in connection with Kuchaikote P.S. Case No. 19/2015.
Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IX, Gopalganj in connection with Kuchaikote P.S. Case No. 17/2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
