JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-09-2019 This application, for grant of anticipatory bail, arises out of Bishanpur P.S. Case No. 7 of 2019, disclosing offences under Sections 302 and 120(B) of the Indian Penal Code. Prosecution case is that brother of the informant had gone to purchase sugar from Ekmi Ghat on motorcycle along with the petitioner at 4.30 P.M. and at about 6.30 P.M. one Kamlesh Yadav came at the house of informant and disclosed that his brother died and the dead body is lying on the road, when he went there he did not find the motorcycle and the petitioner and he suspected that his brother has been killed by the petitioner.
Submission of learned counsel for the petitioner is that he has falsely been implicated in this case only on the basis of suspicion and the postmortem report itself shows that the

Having heard both sides, in view of above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -VII, Darbhanga, in connection with Bishanpur P.S.
