No.4131 of 2004 is applicable in the present case or not, no counter affidavit has been filed. In view of the above, the writ application is disposed of with a direction to the respondent University to examine the claim of the petitioner in the light of decision passed in C.W.J.C. No. 4131 of 2004 and if it is found that the decision of C.W.J.C. No. 4131 of 2004 covers the case of the petitioner, similar treatment should be extended to the petitioner also.
