The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420, 467, 468 and 471/34 of the Indian Penal Code. The prosecution case is that the petitioner took loan for purchase of the vehicle from State Bank of India, KRC Branch, Patna on the basis of forged income tax return and

Patna High Court Cr.Misc. No.2849 of 2016 (2) dt.22-01-2016 2/3 by submitting quotation of the vehicle at the inflated rate. It is submitted by learned counsel for the petitioner that the loan was sanctioned on verification of all the documents. If the income tax return is forged then Income Tax Department will take action against the petitioner. Moreover, the petitioner is repaying the loan amount with interest. The petitioner further undertakes to repay the loan amount with upto-date interest within a period of three months. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail provisionally for four months, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Patna in connection with Kankarbagh P.S. Case No. 459 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

The provisional bail of the petitioner will be confirmed by the learned court below if the petitioner submits
