The petitioner seeks regular bail in connection with Sandesh PS case no. 105 of 2017 instituted for the offences punishable under Sections 30A, 56 of the Bihar Excise and Prohibition Act, 2016.

The allegation is regarding recovery of 171 ltrs. of illicit liquor from a Xylo vehicle.

The learned counsel for the petitioner submits that no recovery has been effected from the conscious possession of the petitioner and he has been falsely implicated in the present case only on account of the fact that the said vehicle belongs to him, however the said vehicle was being driven by someone else.

Considering the nature of accusation, clean antecedent of the petitioner and the period of custody undergone, I deem it fit and appropriate to enlarge the petitioner on regular bail. Accordingly, the petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of 4th A.D.J. Bhojpur at Ara in connection with Sandesh PS case no. 105 of 2017.
