2. The learned counsel submits that petitioner has antecedent of one case and the informant alleges that petitioner had taken his mobile for making a call but thereafter did not return his mobile and when the informant asked him to return his mobile, the petitioner said that he lost it, but after sometime the petitioner informed that mobile is with Dheeraj, accordingly, the informant accompanied the petitioner to the place of Dheeraj where Dheeraj and the petitioner abused him and the petitioner dashed him by the tractor causing injury. It is further submitted hat petitioner has been falsely implicated in the instant case by the informant. It is also submitted that it does not appear probable that the petitioner would have dashed the informant by tractor of Dheeraj for a mobile. It is next submitted that

No.51068 of 2024(2) dt.21-09-2024 2/2 petitioner along with Dheeraj and the informant were sitting on the tractor, inadvertently, the informant fell and got dashed by the tractor. It is also submitted that the date of occurrence is 16.04.2023 and the FIR came to be instituted on 13.05.2023 I.e after a delay of more than a month without any probable explanation.

3. The learned APP opposes the prayer the regular bail application.

Considering the submission, petitioner is directed to be released on furnishing bail bonds of Rs. 25.000/- (TwentyFive Thousand) with two sureties of the like amount eact to the satisfaction of learned ACJM- VI, Nawada in coneection with Hisua P.S. Case No. 246 of 2023, subject to condition that one of the bailer of the petitioner shall be his father, namely, Ashok Yadav @ Ashok Prasad Yadav.
