The petitioner seeks a direction to the Institute of Banking Personnel Selection ('I.B.P.S.' for the sake of brevity) to allow him to appear in the interview on the caste certificate so filed. The legal position stands well settled and 'I.B.P.S.' registered under the Society Registration Act, 1860 has not been held a 'State' within Article 12 of the Constitution of India. In the circumstances, no mandamus can be issued to the 'I.B.P.S.' for the purpose so prayed. The writ petitioner can pursue any other remedy so available to him in law.

The writ petition is disposed of with the liberty aforementioned.
