The petitioners apprehend their arrest in L.N.M.U P.S. Case No. 21 of 2019 corresponding to G.O. Case No. 97 of 2019, registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Informant alleged that while he along with others was on patrolling duty, they saw two persons on a motorcycle were coming and after seeing the police party, both persons fled away leaving their motorcycle. On search, 7.560 litres of liquour was recovered from a plastic bag which was kept on the said motorcycle.

Patna High Court CR. MISC. No.43263 of 2019(4) dt.11-09-2019 2/2 It is submitted on behalf of the petitioners that petitioners were not apprehended on the spot. Nothing has been recovered from the conscious possession of the petitioners. Petitioners have got no criminal antecedent.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge IInd-cumSpecial Judge (Excise Act), Darbhanga in connection with L.N.M.U P.S. Case No. 21 of 2019 corresponding to G.O. Case No. 97 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) vinita/- U T
