JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-01-2017 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Pakridayal Police Station Case No. 114 of 2016 registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code and sections 47, 51, 52, 53 and 54 of Bihar Excise Amendment Act 2016.
Petitioners are not named in the first information report but in course of investigation, when I.O. went through the partnership deed, it came to light that petitioners are also partners in Rudra Construction Limited and, accordingly, petitioners have been made accused in the present case.

Patna High Court Cr.Misc. No.55190 of 2016 (2) dt.12-01-2017 2/2 accused Akhilesh Kumar Singh @ Akhilesh Singh and Veena Devi, having more or less similar allegation, have already been granted privilege of anticipatory bail by different Benches of this Court. Petitioners do not have any criminal antecedent. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran at Motihari in Pakridayal Police Station Case no. 114 of 2016, subject to condition as laid down under Section 438(2) of the Cr.P.C.
