JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The present occurrence is said to have taken place on account of land dispute and it is alleged that petitioner gave one blow of butt of pistol, causing injury on the head of informant. So far as other accused are concerned; they assaulted the informant's brother as well as other family members.
Initially, the present case was registered under Section307 & other minor sections of the Indian Penal Code but after death of injured, Jitendra Prasad, Section-302 of the Indian Penal Code was also added. The deceased Jitendra Prasad was assaulted by co-accused Umesh Prasad and the postmortem report of deceased reveals that only one injury was found on the person of
Patna High Court Cr.Misc. No.441 of 2016 (2) dt.07-01-2016 2/2 the deceased. So far as informant is concerned; he appears to have sustained simple injury.
Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Khaira P.S. Case No. 93 of 2015 to the satisfaction of Sri S. D. Bharti, J.M.-Ist Class, Chapra, Saran. (Hemant Kumar Srivastava, J) A.K.V./- U T
