Petitioner seeks bail in a case registered for the offences punishable under Sections 392,411 of the Indian Penal Code.
The petitioner and other co-accused were apprehended at the spot when fleeing alongwith looted motorcycle. Motorcycle was also recovered. Petitioner is in custody since 29.06.2017.
Considering the nature of allegation against the petitioner, I am not inclined to enlarge him on bail for the present in connection with Bakhtiyarpur Police Station Case No. 206 of 2017 pending in the court of learned Chief Judicial Magistrate, Saharsa/successor court.
Patna High Court Cr.Misc. No.62928 of 2017 (4) dt.21-02-2018 Hence, prayer for bail is refused.
However, the learned trial court is directed to expedite the trial and conclude the same. The petitioner would be at liberty to renew his prayer for bail before the learned trial court after completion of one year of custody, if the trial is not concluded in the meantime.
