The petitioner apprehends his arrest in Patahi P.S. Case No. 50/2015, registered for the offences punishable under Sections 387 and 120B of the Indian Penal Code. The prayer for anticipatory bail of the petitioner was earlier dismissed for non-prosecution on 27.06.2016. The informant alleged that from mobile no.

9709504534 he received a call on his mobile no. 9955284360. The caller disclosed their names, as Nanhku Singh and Tiger and they asked the informant to hand over the extortion money to Sanjeev Boss of Village - Jihuli.

Learned counsel for the petitioner submits that the

Patna High Court Cr.Misc. No.43048 of 2016 (2) dt.11-01-2017 2/2 petitioner has got no criminal antecedent. Petitioner is not the owner of mobile no. 9709504534 and there is absolutely no material against the petitioner to show that the petitioner either instructed the caller of the mobile no. 9709504534 for demanding ransom or he is anyway connected with the crime. It is further submitted that Amit Bhushan Singh has been granted anticipatory bail vide order passed in Cr. Misc. 565/2016. The case of petitioner stands on better footing.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate VIIIth, Motihari in connection with Patahi P.S. Case No. 50/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
