The petitioners seek bail in a case instituted for the offences under Sections 457, 380, 411 and 413 of the Indian Penal Code.

The prosecution case in short is that the accused persons stolen iron rod from an institute.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 17.5.2019 and have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case due to previous

Patna High Court CR. MISC. No.42256 of 2019(2) dt.11-07-2019 2/2 enmity. It is further submitted that the petitioners may be released after completion of three months in custody. On behalf of the State, it is submitted that the petitioners are named in the F.I.R..

Considering the aforesaid facts and circumstances, on completion of three months in custody, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri Ratneshwar Kumar Singh, Sub-Judge-XII-cum- A.C.J.M., Patna in connection with Patliputra P.S.
