Petitioners are in custody in connection with Nokha P.S. Case No. 82 of 2018 for the offence under sections 147, 148, 149, 448, 341, 323, 324, 325, 307 and 302 of the Indian Penal Code.
Learned counsel for the petitioners would submit that petitioners have no criminal antecedent.
Referring to the prosecution case, he submits that the allegation of assault on the deceased is against Kamlesh Ram and not against these petitioners.
In the instant case, case diary was called for. Learned APP with reference to case diary submits that
Patna High Court Cr.Misc. No.73272 of 2018(3) dt.29-01-2019 2/2 materials have come to indicate that the petitioners have also assaulted but there is no specific overt act of assault on the deceased against these petitioners.
Considering the fact that petitioner no.1 is in custody since 20.4.2018 and petitioner no.2 is in custody since 18.4.2018 and they have no criminal antecedent, let the petitioners, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Nokha P.S. Case No. 82 of 2018.
