2. The accused/petitioner apprehending his arrest in connection with Kopa P.S. Case No. 13 of 2025 registered for the offences punishable under Sections 126(2), 132, 121(1), 221 and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

The allegation against the petitioner in the FIR is that the informant, while discharging his official duties intercepted a truck loaded with cement bearing Registration No. JH 05 BU 7836 during routine checking. After checking the documents, he directed the driver to take the vehicle for weighing. However, instead of complying, the driver fled with the truck, parked it in front of Shubhchintak Yadav Line Hotel,

It is further alleged that when the informant insisted on weighing the truck, the driver, the cleaner, the hotel owner Shailesh Rai (the petitioner), along with 3-4 unknown miscreants, assaulted the informant and his driver with iron rod and sticks with the intention of causing their death.
4. It is submitted by learned counsel for the petitioner that petitioner is a reputed person of locality and operates a line hotel. It is further submitted that the petitioner has been falsely implicated in the present case merely because the truck was parked in his hotel by the driver of the truck. Learned counsel has also drawn attention of this Court to the injuries sustained by the informant and further submitted that the allegations against the petitioner are general and omnibus in nature. It is further submitted that the injuries are on the non-vital parts of the body. On these grounds, learned counsel prays for the extension of the benefit of anticipatory bail to the petitioner.
5. Learned APP for the State vehemently opposed the prayer of anticipatory bail.
6. Having considered the rival submissions, this Court finds that the allegations against the petitioner is general and omnibus in nature, and no specific role has been attributed

It is further noticed that the injuries sustained by the informant are on non-vital parts of the body, accordingly, above named petitioner, in the event of his arrest or surrender before the learned trial Court, within a period of four weeks of the order, is directed to be released on bail furnishing bail bond of Rs. 50,000/- (Rupees fifty Thousand) with two sureties of the like amount each to the satisfaction of the learned concerned Court, Saran at Chapra, in connection with Kopa P.S. Case No. 13 of 2025 subject to the conditions as laid down under Section 482(2) of the BNSS, with further condition that:- One of the bailors shall be family member of the petitioner.
